Botulism Castleberry Lawsuit Family of Dead Victim Speaks Out

Filed July 9th, 2008 amy

A New Mexico family suing Castleberry after watching their brother die from botulism-contaminated chili sauce is speaking out in hopes to prevent other families from going through the same thing. In a News 12 article published at wrdw.com, Kevin Caffrey says he remembers his brother, 52-year-old Christopher Caffrey, as a man who loved his big family — the same family that watched him go through “46 days of a nightmare” before they lost him.

“When he was sent to the hospital, at first, they suspected it was a stroke, you know,” his brother told News 12. “Of course, you don’t arrive at botulism because it’s so rare.”

Eventually, doctors in a New Mexico hospital came to that conclusion. According to the lawsuit, Caffrey had Type A Botulism, and his family believes he became poisoned with it after eating Castleberry’s chili. What began with blurry vision and neighbors noticing him falling down let to paralysis days later. He was eventually put on a ventilator.

According to the lawsuit, the chili Christopher ate was still on the shelves, even after a recall. Now his family wants to make sure no other family has to go through what his family went through, saying “Community safety is more important than keeping the production line of this processing plant going.”
